This visa is for those individuals who are looking to come to Australia for marrying their prospective spouses.
It is a temporary visa with a validity of 9 months. Ensure that you are not in Australia upon filing your application and when you are granted a visa. You can marry in any country; the wedding ceremony does not need to be in Australia.

You might be able to get this visa if you plan to marry a person who is:

  • An Australian citizen
  • An eligible New Zealand citizen

You must:

  • Plan to get married and live as husband or wife with your prospective spouse
  • Be sponsored by your prospective spouse
  • Know you and your prospective spouse met in person
  • Be of another gender to your prospective spouse (same-sex couples can apply for a Partner visa based on their de facto relationship)
  • Meet age, health, and character requirements
  • Proof of intent to marry
  • Your application should consist of proof that you plan to marry your prospective spouse within the months of being granted the visa.

If you intend to marry outside Australia, you can provide a letter from the person who will carry out the wedding.

Visa 309 – Partner (Provisional) Visa

Visa 100 – Partner (Migrant) Visa

You could get this visa if you are married to or in a de facto relationship with an:

  • Australian citizen
  • Australian permanent resident
  • Eligible citizen of New Zealand

Make sure you are outside Australia when you apply.

Married applicants

Your marriage must be valid under Australian law. Underage, same-sex, and polygamous marriages are not lawful in the country. The marriage could be valid under inadequate circumstances if one person is lower than 18 years of age. Same-sex couples can apply for this visa, which is on the basis of their de facto relationship.

De facto applicants

Your de facto relationship must have existed for no less than 12 months right away before you apply for this visa. The time that you spent dating your partner does not count towards the length of your de facto relationship.

You might be granted a Spouse Family Partner Parent Visa for Australia visa without being in a de facto relationship for a year if:

  • You can demonstrate compelling and compassionate circumstances, including having dependent children
  • Your partner has been granted a permanent humanitarian visa and your de facto relationship existed before it was issued, and you told about us the relationship before the humanitarian visa was granted
  • Your de facto relationship has been registered in the country, but this is not available in every state and territory.
  • You must be above 18 years and should not be related to your partner by family. This signifies you cannot be an ancestor or descendant of one another or even have a common parent.

Below is a list of people who can be included in your visa application:

  • Your dependent children
  • Other dependent relatives
  • If you choose to add a dependent child to your application, you need to make sure that the child should meet the requirements for including family members in your application. The application needs to include documentary evidence of the child’s relationship with you.

As well, the child dependent on you should be able to show that they meet health as well as character requirements in Australia.
